It’s a photo of a piece of graffiti. Fair use?
It’s not just grafitti. He has plastered it on all kinds of things and is selling the image as a copyrighted work. Fair use does not usually include making money, it’s usually just for scholarly or journalistic purposes.
In other words: if you get sued, you’re on your own.
